Terms of service

By purchasing, downloading, installing, or using FS Kingpin you agree to these terms. If you don't agree, don't install the software.

1. Eligibility

You must be at least 18 years old (or the age of legal majority in your country, whichever is higher) to purchase FS Kingpin. The narrative is intended for adult flight-simulation enthusiasts.

2. License

Your purchase grants you a personal, non-transferable, non-commercial license to install and use FS Kingpin on machines you own or control. You may not redistribute the installer or game files, resell access, or sublicense the software.

3. Acceptable use

• No reverse engineering, decompiling, or repackaging the software for redistribution.
• No automating purchases or abusing refund channels.
• FS Kingpin is a fictional, single-player career mode for a flight simulator. The narrative is entertainment only and is not a guide for any real-world activity.

4. Refunds

FS Kingpin is digital content delivered by immediate download. By completing your purchase you consent to immediate delivery and acknowledge that, under the EU/EEA digital content exception (and the equivalent provisions of Norwegian angrerettloven §22 letter n), your statutory 14-day right of withdrawal is lost once the download begins. This consent is recorded by our payment provider at checkout.

In plain English, this means:

• Before download: if you have purchased but have not yet started the download, you can request a full refund within 14 days of purchase, no reason required.
• After download: refunds are at our discretion and considered case by case. We generally try to help where you've experienced genuine issues. Approval is not guaranteed.
• Defective product: if the game does not work on a system that meets our published minimum requirements, or has a material defect that prevents normal use, you are entitled to a refund under your statutory consumer rights (in Norway, forbrukerkjøpsloven) regardless of the above. Please contact us first so we can try to fix the issue.

To request a refund, use the "View receipt" or "Request refund" link in your purchase confirmation email from Paddle, or email [email protected] from the address used at purchase with your order ID and a brief description of the issue.

Refunds are processed by Paddle and typically appear on your card within 5 to 10 business days.

5. Updates and Early Access

FS Kingpin is in Early Access. The software is playable end to end, but expect rough edges and frequent updates. The base game is sold for a one-time purchase price; this includes every update through full 1.0 release at no additional cost.

Optional paid expansions (DLC) released after 1.0 are separate purchases and not covered by this license. The base game license remains free of further charge.

Updates ship via the in-app auto-updater. You can opt out of auto-updates in app settings.

6. No warranty

The software is provided "as is" without warranty of any kind. We do not guarantee compatibility with every MSFS 2024 configuration, every aircraft mod, or every Windows build. FS Kingpin reads telemetry from Microsoft Flight Simulator 2024 via the SimConnect API, which is owned and operated by Microsoft. We are not responsible for SimConnect connection failures, telemetry inaccuracies, or compatibility breaks caused by MSFS updates, Windows updates, or third-party MSFS add-ons. The system requirements on the homepage describe what we test against. This clause does not limit your statutory consumer rights for defective products.

You install and use FS Kingpin at your own risk. We are not liable for damage to your computer, operating system, MSFS 2024 installation, other software, or stored data caused by installing, running, or uninstalling FS Kingpin, except where such liability cannot lawfully be excluded under your statutory consumer rights.

7. Save data

FS Kingpin stores your career progression in a local SQLite database (player.db) under %APPDATA%/fskingpin/. We do not back up, sync, or warrant the integrity of this file. Crashes, MSFS mod conflicts, system failures, or manual modification may corrupt save state. We recommend keeping a periodic backup of %APPDATA%/fskingpin/ if your career matters to you. We are not liable for lost progression.

8. Liability

Our total liability to you for any claim related to FS Kingpin is limited to the amount you paid for the software. We are not liable for indirect, incidental, or consequential damages, including (without limitation) loss of save data, corruption of the player.db save file, loss of in-game progression, computer failure or malfunction, lost profits, work stoppage, or failure of security mechanisms. Nothing in these terms limits any liability that cannot lawfully be limited, including liability for fraud or for breach of mandatory consumer protection rules in your country of residence.

9. Payment provider and Merchant of Record

Payments are processed by Paddle.com Market Ltd. (Judd House, 18-29 Mora Street, London, EC1V 8BT, United Kingdom), which acts as the Merchant of Record and authorised reseller of FS Kingpin. When you purchase the game, you enter into a contract with Paddle for the transaction, and FS Kingpin is licensed to you by us under the license terms above.

Auto-update endpoints are hosted on GitHub. The auto-updater retrieves version metadata only; see our Privacy Policy for details of any data processed.

10. Termination

We may suspend or terminate your license if you materially breach these terms (for example, by redistributing the installer or attempting to circumvent the license). Termination does not affect any refund rights that have already accrued under section 4. On termination, you must stop using the software and remove all copies from machines you control.

11. Changes to these terms

We may update these terms as the product evolves out of Early Access. Material changes will be announced in-app and on the changelog page, and the version published at the time of your purchase governs that purchase. Your continued use after a change means you accept the new terms for any future purchases.

12. Severability

If any provision of these terms is held to be invalid or unenforceable, the remaining provisions remain in full force and effect.

13. Governing law

These terms are governed by the laws of Norway. Any disputes will be handled in Norwegian courts, without prejudice to your statutory consumer rights in your country of residence.
